COMPANY POLICY

2022 CLEARLY TAHOE COMPANY POLICIES
READ CAREFULLY – PARTICIPANTS MUST UNDERSTAND AND AGREE TO TERMS AND CONDITIONS

In exchange for the participation in the activities organized by Clearly Tahoe LLC and/or use of property, facilities, and services of Clearly Tahoe LLC, I agree for myself and (if applicable), for the members of my party, to the following:

LIMITATIONS: Please review the following limitations prior to making a reservation. Age and weight restrictions do apply. All participants under the age of 18, must be accompanied by an adult (18+) at all times during the activity. Children under the age of 12 must ride in a boat with an adult guest (18+). All participants must be over the age of 6. Guests under the age of 18 must have a parent or legal guardian present to sign liability waiver. Children will be defined as ages 6-11 and shall be priced as children. Youth will be defined as ages 12-17 and shall be priced as youth. All guests must be physically and mentally capable of participating in described activity. Participants must agree to disclose any knowledge of medical history that might affect his/her or their dependents ability to participate in described activity. No more than two occupants are permitted in one boat. Guests will not be permitted to share seats during the activity. Total combined capacity must not exceed a weight of 375lbs.

RESPONSIBILITY OF PARTICIPANTS: It is the responsibility of our guests to review and agree the following prior to making a reservation. Violation of company policies or inability to meet the necessary requirements as defined in these policies, may result in same-day cancellation or post-check-in cancellation policies without refund. Participants must provide their own transportation to and from scheduled check in site. Guests must arrive on-site for mandatory check-in no less than 30 minutes prior to their scheduled tour. All participants must agree to and sign a liability waver provided by Clearly Tahoe LLC in order to partake in scheduled activity. If participant is a minor, a parent or legal guardian must be present to sign waiver on behalf of the child or youth guest. PHYSICAL/MENTAL REQUIREMENT OF PARTICIPANTS: All guests will be required to paddle at a reasonable pace with occasional breaks during the duration of the tour. Participants may be required to enter the water prior to boarding the boats. All participants must be capable of entering and exiting the boat without assistance. Guests should be prepared to swim a short distance if necessary.

Kayak Tours and Clearly Explorer Excursions: Guests must listen to guides and representatives of Clearly Tahoe, LLC during safety speech as well as during activity. Participants will be required to wear a US Coast Guard approved life preserver provided by Clearly Tahoe LLC. All personal life preservers must be inspected and approved by our Clearly Tahoe staff. Life preservers must be worn at all times on the water or near the water. Guests are responsible for their own safety pre and post activity as well as during scheduled breaks. Personal items should be kept in dry bag or kept in a safe environment. Clearly Companies, Clearly Tahoe LLC and/or Clearly LLC prohibits any kind of container or bag that might scratch or damage the kayaks in any way. Clearly Companies, Clearly Tahoe LLC and/or Clearly LLC is not responsible for any loss or damage to personal items resulting from participation in described activity. No alcohol, drugs or controlled substances of any kind will per permitted on the kayaks. No smoking will be permitted during tour. No weapons of any kind will be allowed in the kayaks. No does or professional camera equipment will be permitted on public tours.

RIGHT OF REFUSAL: Clearly Companies, Clearly Tahoe LLC and/or Clearly LLC reserve the right to refuse service to any participant at any time for any reason before or during activity without refund. The employees or representatives of Clearly Companies, Clearly Tahoe LLC and/or Clearly LLC may refuse service if any participant seems potentially harmful to themselves or others.

Shoreline Kayak Tours: Shoes and sharp objects must be removed or covered prior to entering the boat with the exception of tight-fitting neoprene or rubber water shoes. Guest should be prepared for the possibility of getting wet and should dress accordingly. It is recommended to wear sunscreen, hats and protective clothing when exposed to the sun for an extended period of time. Eco and LED Tours: Low profile footwear is highly recommended. No heavy boots or heels will be permitted in the kayaks. Light layers and jackets are highly recommended. Hats, sunglasses, sunscreen and big spray may be necessary. Guest should be prepared for the possibility of getting wet and should dress accordingly.  Gloves are recommended early spring and late fall activities. Clearly Explorer Kayak Excursions: Low profile footwear is highly recommended. No heavy boots or heels will be permitted in the kayaks. Light layers, hats, sunscreen and sunglasses are highly recommended. Guest should be prepared for the possibility of getting wet and should dress accordingly. Jackets and gloves may be necessary for early spring, late fall, winter and evening experiences.

PET POLICY: Small dogs under 30lbs may be permitted on select tours at select locations with advance reservation. Advance reservation is required. Limitations and Clearly Tahoe Pet Policy applies. Pets will be limited to well behaved dogs with valid vaccinations including but not limited to Rabies. No other pets shall be permitted to accompany guests on any Clearly Tahoe experiences. Applicable dogs may be added to select tours at the rate of $20.00 per pet. All pet policies and fees apply. Approved dogs may be permitted to accompany an adult guest (18+) on select tours. Dogs will not be permitted in a boat without an adult passenger. All dogs must be well behaved and restrained during the entire experience on no more than a 6ft leash. Dogs may not be confined to a carrier or other restrictive forms of containment beyond a leash during activity. Dogs must be kept on lap or may be kept in a carrier during shuttle transportation. Dogs will not be permitted on the seats or in the front of the shuttle at any time. Guests agree to take full responsibility of their dog during as well as pre and post activity. SERVICE ANIMALS: If a service animal is necessary, arrangements can be made. Any special arrangements involving service animals or medical needs must be made at time of booking or a minimum of 48 hours prior to scheduled activity. FOR THE SAFETY OF OUR GUESTS AS WELL AS THE SERVICE ANIMAL, TOUR OPTIONS MAY BE LIMITED. For more information regarding service animals please contact our reservation office at [email protected]

LATE ARRIVALS: All guests must arrive at designated check-in no less than 30 minutes prior to their scheduled tour. Guests who arrive late for check in or attempt to check in at an alternative location, may miss their scheduled tour. Late arrivals, no-shows or cancellations made post-check-in will be non-refundable. Check-in delays due to inability to find parking, gather group or meet requirements are defined in our company policies is the responsibility of our guest and will still be subject to late arrival policies. BOOKING ERRORS: Reservations made more than (48) hours prior to scheduled activity have a twenty-four-hour booking error window from the time of initial reservation. Cancellations due to reservation error are subject to a full refund to the initial method of payment on file. Cancellations must be made by completing our online Reservation Change/Cancellation form within defined booking error window. Cancellations may take up to 48 hours for processing. Reservations made within 48 hours but more than 1-day before scheduled activity shall have a 1-hour booking error window. Same-day reservations are excluded from booking error policies and shall have no booking error window.  RESERVATION CHANGES: Reservation changes may be possible but are not guaranteed. Reservation changes must be requested by completing our online Reservation Change/Cancellation Form no less than 72 hours prior to the check-in time for that activity. There is no reservation change fee for approved reservation changes made more than 72 hours prior to scheduled check-in. Upon approval, any additional fees resulting from price alterations shall be automatically charged to the primary card on file unless otherwise noted. Any amount due will be refunded onto initial method of payment or gift as per our Cash Refund Policy. LAST MINUTES RESERVATION CHANGES: Last minute reservation changes including but not limited to altering number of guests, ages, seating arrangements, tour type, tour date or time made within 72 hours of scheduled check-in are not guaranteed. Last minute reservation change requests must be made online by completing our Reservation Change/Cancellation form and may require up to 48 hours for processing. Approved last-minute reservation changes may be subject to a 50% reservation change fee.  STANDARD CANCELLATION: Cancellations must be made by completing an online Reservation Change/Cancellation form on our website no less than one (1) week prior to the day of scheduled activity to receive a cash refund. Cancellations made more than one (1) week before the day of scheduled activity may be eligible for a full cash refund less a $20.00 Cancellation Fee per boat. Reservation Change/Cancellation Form is available on our website at www.clearlytahoe.com. CASH REFUNDS: Cash refunds will be automatically issued to the initial method of payment on file. Refund may not be issued to any other card. Cancellations made less than one (1) week prior to the start of scheduled activity will not be applicable for any cash refund.

PRIVATE AND GROUP BOOKING POLICY: Private parties or groups requesting special accommodations may be subject to our Clearly Tahoe Group Policies. A $500.00 non-refundable deposit is required at the time of reservation for any reservation hold. Remaining balance shall be due in full 14-days prior to scheduled activity. Payment must be made in full by one party and cannot be broken down for attendees. PRIVATE AND GROUP CANCELLATION POLICY: Cancellations must be made within 14 days of scheduled group activity to obtain a cash refund less non-refundable deposit and applicable cancellation fees. No Show: Late arrivals, no show guests and cancellations made less than 14 days prior to scheduled activity will be non-refundable. PRIVATE AND GROUP RESERVATION CHANGES: Reservation Changes can be requested but are not guaranteed and subject to availability. Approved changes will be billed and due at the time of approval. GROUP ACCOMMODATIONS: Groups exceeding 12 guests will be required to check in 15-minutes earlier or 45 minutes prior to the start time of their scheduled trip and may need to break down into “pods” for launching and shuttle transportation. GIFT CARD REFUND: Clearly Tahoe Experience Gift Cards are issued for specific activities and may be transferred and applied to any Clearly experience at any of our Clearly locations. Clearly Tahoe Experience Gift Cards are not applicable for retail merchandise. GIFT CARD PURCHASE/REFUND: All gift card purchases are final. No refunds shall be made from time of purchase. Gift Cards are issued for specific activities and may be transferred and applied to any Clearly experience at any of our Clearly locations, reservation change request may be required. Gift cards can be applied to online reservations or by contacting our reservation office at (530)554-4664. Gift Cards may be combined with other discounts and offers. Gift card balance cannot be redeemed for cash.  GIFT CARD TRANSFER: Gift Card Transfers must be made online by completing a Reservation Change/Cancellation Form and may take up to 48 hours for processing. Clearly Tahoe Experience Gift Cards are not applicable for retail merchandise. GIFT CERTIFICATES/GIFT CERTIFICATE REFUND: Promotional Gift Certificates may be applied to specific activity only and are not transferrable to other experiences or locations. Gift certificates may only be used one time and cannot be combined with any other discounts or offers. Unused balance on gift certificates is non-refundable and may not be redeemed for cash value. Gift certificates are valid through expiration date only. MERCHANDISE RETURN: Clearly Merchandise purchased directly through a participating Clearly location may be subject to a full refund within seven (7) days of purchase. Customer must have original purchase receipt. Merchandise must show no signs of wear or usage prior to return. MERCHANDISE EXCHANGE: Exchanges can be made within thirty (30) days of purchase. Item must show no signs of wear or usage. Exchanges are based on availability. Products could be exchanged for item of equal or lesser value. Original purchase receipt must be presented at the time of exchange. No monetary refund will be provided. Merchandise purchased via third party companies or sponsors will be subject to third party return/cancellation policies. THIRD PARTY PURCHASES: Items ordered on our website through third party retailers are subject to the policies of that third party retailer. Clearly Companies, Clearly Tahoe LLC and/or Clearly LLC take no responsibility for transactions through third party companies.
