2022 CLEARLY TAHOE | RENTAL POLICIES
READ CAREFULLY – PARTICIPANTS MUST UNDERSTAND AND AGREE TO TERMS AND CONDITIONS
In exchange for the participation in the activities organized by Clearly Tahoe LLC and/or use of property, facilities, and services of Clearly Tahoe LLC, I agree for myself and (if applicable), for the members of my party, to the following:
LIMITATIONS: Age and weight restrictions do apply. All participants under the age of 18, must be accompanied by an adult (18+) at all times during the activity. Children under the age of 12 must ride with an adult guest (18+). All participants must be over the age of 5 and must not weight less than 30lbs. Absolutely no exceptions. Guests under the age of 18 must have a parent or legal guardian present to sign liability waiver. Children will be defined as ages 5-11. Youth will be defined as ages 12-17. Vessel capacity must not exceed the passenger limit and combined weight restrictions as specified at check-in. ADDITIONAL LIMITATIONS: Paddleboards are only available in-season and will not be available for winter rentals. Children under the age of 12 will not be permitted on activities between December 1st and February 28th . During this time, Youth passengers must ride with an Adult (18+). Rentals will not be available in Wind advisory Conditions, days with air temperature below 32 degrees at regular operating hours or hazardous air quality conditions as determined by AQI index. Rentals will be immediately recalled in the event of sudden thunderstorms or unsafe operating conditions. CHECK IN PROCESS: All participating guests must arrive for check-in no less than 30 minutes prior to their scheduled rental for outfitting and safety brief. Guests who miss check-in will not be able to participate or will be required to wait for the next available safety brief. Rental fees will not be adjusted during this time. Guest will not be permitted to take part in any rental activities before attending a Safety Brief and Lesson. RENTAL AREA: Vessels must remain within defined rental area. Rental may be terminated for vessels that violate rental boundaries. Guest will be responsible for all rental time leading up to time of termination. Rental area may be reduced to a smaller region or limited area according to wind, weather and uncontrollable conditions. Pricing will not be adjusted to reflect rental boundaries. RATES: There is a 1-hour minimum for all rental equipment. Rates shall be determined by vessel as well as duration of use. Rental time will begin at scheduled departure and will be rounded up to the next hour for late arrivals. Late arrivals may also be subject to a late fee of $100.00 per vessel in addition to hourly rental rates. Rentals will not be pro-rated within the hour for early returns. LOST/DAMAGED EQUIPMENT: Guests shall be responsible for any damage to rental equipment at a rate not to exceed the maximum replacement cost specified on Rental Agreement. Guests are responsible for inspecting all rental equipment and vessels prior to departure to ensure all items are free of defects before use. PAYMENT: I understand that by completing the Rental Agreement, I authorize Clearly Tahoe to charge my card on file for any applicable taxes and fees resulting from my or my party’s participation in activity. RESPONSIBILITY OF PARTICIPANTS: It is the responsibility of our guests to review and agree the following prior to making a reservation. Violation of company policies or inability to meet the necessary requirements as defined in these policies, may result in immediate termination of activity without refund. Participants must provide their own transportation to and from rental location and are responsible for any and all parking or park entry fees associated with parking or access to the rental location. Guests must arrive on-site for mandatory check-in no less than 30 minutes prior to their scheduled rental for outfitting and safety lecture. Guests must not be intoxicated at the time of or during rental activity. All participants must agree to and sign a liability waver provided by Clearly Tahoe LLC in order to partake in scheduled activity. If participant is a minor, a parent or legal guardian must be present to sign waiver on behalf of the child or youth guest. PLEASE NOTE: All Clearly Tahoe rental vessels are equipped with GPS trackers. Guests must understand and agree to these safety requirements prior to participation in rental activity. Guests shall not be permitted to remove or tamper with devices in a way that may inhibit their intended use. PHYSICAL REQUIREMENT OF PARTICIPANTS: Participants may be required to enter the water at the start of their rental as well as upon return. All participants must be capable of entering and exiting the boat without assistance. Guests may be required to swim a short distance if necessary and should not participate in rental activities if they are unable to safely do so. RULES AND REGULATIONS: Guests must listen to guides and representatives of Clearly Tahoe LLC during safety brief as well as through duration of activity. Participants will be required to wear a US Coast Guard approved type III life preserver provided by Clearly Tahoe LLC as well as leash (if applicable). All personal life preservers must be inspected and approved by our Clearly Tahoe staff. Life preservers and leashes (if applicable) must be worn at all times on the water or near the water. Guests are responsible for their own safety pre and post activity as well as during scheduled breaks. Personal items should be kept in dry bag or kept in a safe environment. Clearly Tahoe LLC prohibits any kind of container or bag that might scratch or damage the vessels in any way. Clearly Tahoe LLC is not responsible for any loss or damage to personal items resulting from participation in described activity. No alcohol, drugs or controlled substances of any kind will per permitted on rental vessels. No smoking will be permitted during check-in or during safety brief. No weapons of any kind will be permitted within rental area. No glass bottles will be permitted in waterfront areas or while using recreational vessels. Drones are not permitted within Nevada State Park boundaries unless authorized with a Special Use Permit. Special Use Permit for an “unmanned aircraft” must be through the State of Nevada, Division of State Parks. All FAA restrictions apply. RIGHT OF REFUSAL: Clearly Tahoe LLC reserves the right to refuse service to any participant at any time for any reason before or during activity without refund. The employees or representatives of Clearly Tahoe LLC may refuse service if any participant seems potentially harmful to themselves or others. PET POLICY: Pets are not permitted within Sand Harbor State Park boundaries between mid-April and mid-October and are subsequently not permitted on rentals during this time. During applicable period, only small dogs under 30lbs may be permitted. Clearly Tahoe Pet Policy applies. Dogs must be up to date with all legally required vaccinations including, but not limited to, rabies. Dogs must be well behaved and always restrained by an adult passenger (18+) on no more than a 6ft leash. Dogs may not be confined to a carrier or other restrictive forms of containment beyond a leash during activity. Handler agrees to take full responsibility of their dog during as well as pre and post activity. Handlers will be responsible for removing and properly disposing of pet waste within the Sand Harbor State Park Boundaries. SERVICE ANIMALS: If a service animal is necessary, certain arrangements can be made. Any special requests involving service animals or medical needs should be made in advance by contacting our reservation office.

Maximum number of guests per vessel as well as combined weight limitations vary between various types of vessels and recreational equipment. Guest capacity and weight restrictions are available at the time of booking. Vessel capacity must not exceed the passenger limit and combined weight restrictions as specified at the time of booking.

- Primary renter must review and agree to Clearly Tahoe Rental Policies, pricing and fees on behalf of themself and their party.
- All guests must complete a liability waiver prior to participation in any Clearly Tahoe LLC activity. Parent or legal guardian must be present a the time of check-in must review and agree to liability waivers on behalf of child or youth guests.
- Participants must not be intoxicated prior to or during rental activity. Guests who demonstrate visible signs of intoxication may be refused service or recalled from participation in activity.
- All participating guests must attend a safety lecture and lesson prior to participation in rental activities.
- Guests must listen to guides and representatives of Clearly Tahoe LLC during safety brief as well as through duration of activity.
- Renters must remain within designated rental boundaries as defined at the time of booking.
- Participants will be required to wear a US Coast Guard approved type III life preserver provided by Clearly Tahoe LLC as well as leash (if applicable).
