2025 CLEARLY TAHOE COMPANY POLICIES
READ CAREFULLY – PARTICIPANTS MUST UNDERSTAND AND AGREE TO TERMS AND CONDITIONS: In consideration for my participation in the activities organized by Clearly Tahoe LLC and/or use of property, facilities, and services of Clearly Tahoe, I agree to the following for myself and (if applicable), for the members of my party, to the following:
RESPONSIBILITY OF PARTICIPANTS: It is the responsibility of our guests to review these Policies prior to making a reservation or participating in any Clearly Tahoe activity. Violation of company policies or inability to meet the necessary requirements as defined in these policies, may result in cancellation or termination of activity without refund.
All guests, by participating, warrant that they have determined in their sole discretion that they are capable of safely participating in the Clearly Tahoe activities. Guests (including persons with health conditions that may affect participation such as pregnancy) are solely responsible to determine their own capability to participate, in consultation with their health care providers as appropriate. Clearly Tahoe retains the right to refuse services to anyone if Clearly Tahoe staff has safety concerns for any reason about any guest’s or guest’s pet’s participation. Where feasible, reasonable accommodations can be made for disabled guests with advance notice.
Guests are responsible for selecting the appropriate booking options (such as age, seating arrangements, location of activity and date of service) at the time of reservation. Guests are responsible for all booking errors outside of the boking error window. Participants must provide their own transportation to and from scheduled check in site. Guests must arrive on-site for mandatory check-in no less than 30 minutes prior to the start time of their scheduled activity unless specified otherwise in activity confirmation email. Guests must not be under the influence of alcohol or substances (legal or illegal) before or during the experience. Guests must abide by all posted and verbal rules and regulations.
All participants must agree to and sign a liability waiver provided by Clearly Tahoe LLC to partake in scheduled activity. If participant is a minor, a parent or legal guardian must be present to sign waiver on behalf of the child or youth guest.
Participants will be required to wear safety equipment for each activity as instructed by Clearly Tahoe LLC. Required safety equipment will be available for loan or rent. All personal safety equipment brought by participants is subject to inspection and approval by Clearly Tahoe staff. However, such inspection and approval cannot guarantee that the equipment will be free of undetected defects. Use of safety equipment such as helmets and life preservers cannot guarantee participants’ safety. Both adults and children must wear USCG Approved Type III Life Preservers as well as a leash (if applicable) at all times on recreational paddle-sport equipment. Children under the age of 12 must always wear USCG Approved Type III life preservers when on or in the water. Guests must abide by activity-specific dress code, please reference activity-specific listing for dress code guidelines.
Personal items should be kept in dry bag or in a safe environment. Clearly LLC is not responsible for any loss or damage to personal items resulting from water exposure or other risks associated with participation in recreational activities. Additionally, Clearly Tahoe is not responsible for retrieving items or reimbursing guests for lost or damaged items.
Guests will be responsible for damages to Clearly Tahoe equipment and/or trip interruption by guest (for example, where guest’s or guest’s pet causes a disruption to or early termination of services for guest and/or others) at a rate of replacement cost + 20% fee. Assessment of damages will be made upon return and automatically charged to the method of payment on-file.
LIMITATIONS: Please review the following limitations prior to making a reservation.
Age and weight restrictions do apply. All participants must be at least 4 years of age and must weigh over 30lbs to participate in any recreational paddle-sport or cycling activities. Further age restrictions apply to specific Clearly Tahoe activities. Guests are responsible for reviewing and abiding by minimum age restrictions for each activity. All participants under the age of 16, must be accompanied by an adult (18+) at all times during the activity. Parent or legal guardian must be present to sign liability waiver on behalf of any participating guest under the age of 18. Children under the age of 12 must ride in a boat with an adult guest (18+) outside buoy marked rental area. Children will be defined as ages up to 11 and shall be priced as “children”. Youth will be defined as ages 12-15 and shall be priced as “youth”. Teens will be defined as ages 16-17 and shall be priced as “teens”. Participants ages 18+ will be classified as an “adult” and shall be priced as an adult.
No more than one participant per seat. Guests will not be permitted to share seats during the activity. Weight restrictions do apply. Please reference activity-specific listings for details.
PHYSICAL REQUIREMENTS: All guests will be required to participate at a reasonable pace with occasional breaks during the duration of the tour. All guests must be capable of safely using equipment without assistance. Guests may be required to enter the water for use of recreational water sports equipment. Guests participating in water related activities should be prepared to swim a short distance if necessary. Additional physical requirements may apply, please reference activity-specific listing for more information.
RULES AND REGULATIONS: No alcohol, drugs (legal or not) or controlled substances of any kind will be permitted on rental equipment or guided tours. No smoking will be permitted during check-in, safety brief or on guided recreational experiences. No weapons of any kind will be permitted within rental area or guided tours. No glass bottles will be permitted in waterfront areas or while using recreational vessels. Clearly Tahoe LLC prohibits any kind of container or bag that might scratch or damage the equipment in any way.
DRONES AND FILMING: No drones or professional camera equipment will be permitted on public tours or within Nevada State Park boundaries. Requests for drone use and/or professional photography can be made by completing a Media Inquiry form on our website at clearlytahoe.com and is subject to approval by Clearly Tahoe. Additional Special Use Permits, licensing and authorization may be required. All FAA restrictions apply.
TRACKERS: All Clearly Tahoe rentals may be equipped with GPS trackers. Devices are intended to monitor equipment while in use and should not imply safety. Guests are not permitted to open containers, remove or tamper with devices in a way that may inhibit their intended use. Guests must not attach/detach trackers without staff assistance. Guests agree to these terms by participating in any rental activity.
RENTAL REGION: It is the responsibility of Clearly Tahoe guests to review and understand the designated rental boundaries and daily limitations prior to participation in rental activities. Clearly Tahoe reserves the right to reduce rental regions in the event of wind, weather or other safety-related circumstances. Rental rates will not be adjusted to reflect limited use.
LOST/DAMANGED EQUIPMENT: Guests are responsible for inspecting all equipment and reporting any defects or damage prior to use or participation in activity. Guests are responsible for any lost or damaged equipment at a rate of replacement cost + 20% fee. Fees resulting from and incidentals will be charged to the card on file.
LATE FEES / EQUIPMENT RETRIEVIAL FEES: Guest who exceed rental time, exit rental boundaries or abandon equipment may be subject to Late Fees, Retrieval Fees and/or charges resulting from lost or damaged equipment. Late return fees will result in a $100.00 Late Fee per item in addition to excess time used. Guests who exit the designated rental area or abandon equipment for more than 30 minutes will be subject to a $100.00 Retrieval Fee per item and up to a maximum daily rental rate + 18% Service Fee.
RIGHT OF REFUSAL: Employees or representatives of Clearly Tahoe LLC reserve the right to refuse service to any participant at any time for any reason before or during activity without refund.
PET POLICY: Pets are only permitted on select activities at select locations. Pets will be limited to well behaved dogs under 30lbs with valid Rabies vaccinations. No other pets shall be permitted to accompany guests on any Clearly Tahoe experiences. Advanced reservations are required. Applicable dogs may be permitted to accompany an Adult handler (18+) at a rate of $20 per dog. No more than one dog will be permitted per handler and no more than one dog will be permitted per boat. All dogs must be well behaved and restrained during the entire experience on no more than a 6ft leash. Dogs must not be confined to a carrier or other restrictive forms of containment beyond a leash during activity. Dogs must be kept on handler’s lap during shuttle transportation. Handlers will be responsible for removing and properly disposing of pet waste. Handler agrees to take full responsibility of their dog during as well as pre and post activity. Handlers take full responsibility for any liability related to the dog (including but not limited to dog bites or other injuries caused by the dog). Employees or representatives of Clearly Tahoe LLC reserve the right to refuse services due to a violation of Pet Policies without refund.
SERVICE ANIMALS: If a service animal is necessary, please contact us to discuss what arrangements can be made. Any special arrangements involving service animals or medical needs should be made at time of booking or a minimum of 48 hours prior to scheduled activity. FOR THE SAFETY OF OUR GUESTS AS WELL AS THE SERVICE ANIMAL, LIMITATIONS MAY APPLY. LATE ARRIVALS: All guests must arrive at designated check-in location no less than 30 minutes prior to the start time of their scheduled tour unless specified otherwise in activity confirmation email. Guests are responsible for obtaining the correct address of check-in location from the activity-specific listing at the time of booking. Guests who arrive late for check in or attempt to check in at an alternative location, may miss their scheduled tour. Late arrivals will be non-refundable. Please plan to arrive with plenty of extra time. Clearly Tahoe LLC is not responsible for delays due to traffic, roadwork, inability to find parking, or inability to meet other requirements outlined in company policies.
RESERVATION CHANGES: Changes made to a current reservation day, date time or activity will result in a $20.00 Reservation Change Fee per request. Reservation Changes may be possible but are not guaranteed. Reservation Changes must be requested by completing our online Reservation Change/Cancellation Form no less than 48-hours prior to the check-in time for scheduled activity. Upon approval, any additional fees resulting from Reservation Change will be automatically charged to the method of payment on file unless otherwise noted. Cancellation Fee shall apply to any cancelled guests as per Cancellation Policy. Any remaining amount will be refunded as per our Refund Policy. Guest is responsible for original reservation if Reservation Change request is not approved.
CANCELLATION POLICY: Cancellations can be made up 48-hours prior to the check-in time for scheduled activity. Cancellations will result in a 50% Cancellation Fee plus booking fees. Full cancellations can be made via the cancel booking link in confirmation email. For customer assistance with cancellations, or for partial cancellations, please complete our Reservation/Change Cancellation form on our website. Reservation Change/Cancellation Form is available on our website at www.clearlytahoe.com.
REFUND POLICY: Cancellations made 48-hours prior to the check-in time for scheduled activity will be eligible for a full refund less a 50% Cancellation Fee and booking fees. Cancellations made within 48 hours of scheduled check-in time will be non-refundable. Refunds will be automatically issued to the original purchase method. NO REFUND WILL BE APPLIED TO CANCELLATIONS OR RESERVATION CHANGES MADE WITHIN 48-HOURS OF SCHEDULED CHECK-IN TIME.
BOOKING ERROR: Guests may be exempt from Cancellation Fees if Cancellation is made within Booking Error window.
For Advance Reservations (Booked More than 48 hours in Advance):
Reservations made more than 48-hours prior to scheduled activity have a 24-hour booking error window from the time of initial reservation.
For Last Minute Reservations (Booked 24-48 hours in Advance):
Reservations made within 48-hours but more than 24-hours before scheduled activity shall have a 1-hour booking error window from the time of initial reservation.
Same Day Reservations (Booked within 24 hours of Activity Start):
Same-day reservations are excluded from booking error policies and shall have no Booking Error window.
Cancellation Requests as a result of Booking Error must be made by completing our online Reservation Change/Cancellation form within defined Booking Error window. Cancellations may take up to 48-hours for processing.
INCLEMENT WEATHER: In the event of unfavorable wind or weather conditions or any cancellation on the part of Clearly Tahoe LLC due to uncontrollable factors we do provide a full 100% refund to the initial method of payment on file. We reserve the right to cancel at any time for any reason in our sole discretion if we feel conditions may be unsafe or encounter operating factors beyond our control.
MULTI TOUR DISCOUNT: Guests who book a second tour with Clearly Tahoe within 1 week of the first may be eligible for a 20% Multi-Tour discount. Second experience must be on a different tour and occur within 7 days of the first activity. Discount will apply to a tour of equal or lesser value only. Guests must contact our reservation office at reservations@clearlytahoe.com to request application of the multi-tour discount. Multi-Tour discount can be applied to an existing reservation and will result in a refund of the discounted amount less 3rd party booking and processing fees. Multi-Tour discounts cannot be applied after the tour has taken place.
GIFT CARD REDEMPTION: Clearly Tahoe Gift Cards are issued for specific purchases. Tour Gift Cards can only be applied to Clearly Tahoe tours but can be transferred between tour locations upon request. Clearly Tahoe Adventure Shop Gift Cards can only be applied to retail purchases at one of our participating Clearly Tahoe Adventure Shops. Gift Card balance cannot be redeemed for cash. All gift cards issued after January 1st, 2025 will have an expiration of 5 years from the date of issue.
VOUCHERS/CREDITS/GIFT CERTIFICATES: Vouchers, Credits and Gift Certificates may be applied to a specific activity only and are non-transferable to other experiences or locations. Vouchers, Credits and Gift Certificates may only be used one time and cannot be combined with any other discounts or offers. Any unused balance on Vouchers, Credits or Gift Certificates will be non-refundable and cannot be redeemed for cash value. Vouchers, Credits and Gift Certificates may have black-out dates and are valid through expiration date only.
RETAIL PURCHASE POLICY: Discounted items are final sale and cannot be returned. Non-discounted items can be exchanged for store credit or items of equal or lesser value within 30 days of purchase. Original purchase receipt may be required. Online purchases will be subject to online purchase policies. Items purchased at our Sand Harbor rental concession will be final sale and cannot be returned.
THIRD PARTY PURCHASES: Merchandise or experiences purchased via third party companies or sponsors will be subject to third party return/cancellation policies. Items ordered on our website through a third party are subject to the policies of that third party company. Clearly Tahoe LLC takes no responsibility for transactions through third party companies.

Clearly Tahoe Adventure Shop Gift Cards can only be applied to retail purchases at one of our participating Clearly Tahoe Adventure Shops. Gift Card balance cannot be redeemed for cash. All gift cards issued after January 1st, 2025 will have an expiration of 5 years from the date of issue.
